LAW MAKERS BECOME LAW BREAKERS IN UNAUTHORISED CONSTRUCTIONS (SEE ATTACHMENTS)



Documents received under RTI Act reveal shocking details that our law-making Parliamentarians are privileged law-breakers because unauthorized constructions carried out by them in government-provided bungalows are not bulldozed till they are on posts! Surprisingly long list of such law-breaking Parliamentarians include members from all the political parties.



List provided by CPWD deliberately ignores unauthorized statue of late Babu Jagjiwanram ji at bungalow number 6 Krishna Menon Marg (New Delhi) earlier put by present Lok Sabha Speaker Meira Kumar when the said bungalow was allotted to her in her capacity as Parliamentarian or Union Minister as also admitted by Directorate of Estate under an earlier RTI response.



Parliamentarians should be role-model for enforcing rule of law. Union government should take immediate steps to remove all unauthorized structures from government-bungalows without waiting for these to be vacated by present privileged VVIP occupants.

I vide my RTI petition dated 12.11.2010 detailed and complete information together with related documents/correspondence/file-notings etc on under-mentioned aspects relating to chapter 10 of CPWD Maintenance Manual read with Annexure 16 & 17 as provided to me by Lok Sabha Secretariat under RTI response and a news-clipping ‘Unauthorized construction in government accommodations of 99 Parliamentarians” (Hindustan Hindi 08.11.2010):

1. Complete list of Parliamentarians, Ministers and others having done unauthorized construction in government-provided accommodations mentioning complete and detailed information on such unauthorized constructions

2. Detailed list of those having done such unauthorized constructions as in query (1) above who took permission of CPWD or any other competent/authorized authority for such unauthorized construction in government-provided accommodation with copies of any such permission-letter/s

3. Detailed list of those having done such unauthorized constructions as in query (1) above who informed CPWD or any other competent/authorized authority for such unauthorized construction in government-provided accommodation with copies of giving such information to CPWD/others

4. Name of person/authority having occupation of government-provided accommodations when the said unauthorized construction were carried out at these public-properties

5. When CPWD/Directorate of Estate or any other concerned authority first noticed such unauthorized constructions at government-provided accommodations?

6. Names with designations of government-staff responsible to have watch on unauthorized structures in government-provided accommodations area as per paragraph 10.1 of CPWD Maintenance Manual

7. Copy of report of unauthorized constructions at these government-provided accommodations as per paragraph 10.1(ii) of CPWD Maintenance Manual

8. Steps taken to demolish (or shift) the unauthorized constructions from government-provided accommodations

9. Copy of report, FIR etc filed to Police for immediate prevention of unauthorized government-provided accommodations as mandatory under paragraph 10.1(ii) and 10.1(iii) of CPWD Maintenance Manual

10. Copy of notices to occupiers of government-provided accommodations for unauthorized constructions as required in paragraph 10.1(iii) of CPWD Maintenance Manual

11. Other steps taken to remove unauthorized constructions from government-provided accommodations, and also against responsible one/s to carry out unauthorized constructions at government-provided accommodations as per all the provisions read together in chapter 10 of CPWD Maintenance Manual read with its annexure 16 and 17

12. Do any unauthorised name-boards exist outside government-provided accommodations?

13. If yes, steps taken to remove the unauthorised name-boards from government-provided accommodations

14. List of unauthorized name-boards outside government-provided accommodations

15. Complete and detailed information of persons guilty of taking away items/fittings/accessories etc from their government-provided accommodations when they vacated these accommodations

16. Steps taken to recover such taken-away goods etc and/or to recover cost of such taken away items/fittings/accessories etc

17. Time-period allowed to retain government-provided accomodation by the allottees after having lost entitelement to retain these

18. Complete and detailed information on ‘rents at market value’ fixed and imposed per month/annum for various categories of government-accomodations from those occupying government-provided accomodations after losing entitlement to retain these

19. When were these ‘rents at market value’ last fixed?

20. Mode and criterian to fix ‘rents at market value’ mentioning periodicity of their revision

21. Is it true that ‘rents at market value’ fixed by government is actually too less and a small fraction of actual prevailing/possible market-rents of such prime-properties?

22. If yes, complete and detailed information on fixing ‘rents at market value’ fixed by government which is too less and a small fraction of actual prevailing/possible market-rents of such prime-properties

23. Complete and detailed list of defaulters of ‘rents at market value’ by occupiers of government-provided accomodations occupying these after having lost entitelement of such government-provided accomodations

24. Steps taken to recover ‘rents at market value’ by defaulters as occupiers of government-provided accomodations occupying these after having lost entitelement of such government-provided accomodations

25. Complete and detailed list of such defaulters where such due ‘rents at market value’ has been written-off as bad debts together with relevant file-notings/corrospondence documents etc

26. Latest status of government-accommodations still occupied by those having lost entitlement mentioning also date of losing their entitlement

27. Steps taken to get government-accommodations vacated from those losing entitlements

28. Any other related information

29. File-notings on movement of this RTI petition as well



Learned CPIO at Delhi Central Division –IV vide a much delayed response-number 1(3)/DCW-4/GA/385 dated 02.02.2011 gave information on some of the queries together with some related documents.



Query-number (1)

List of unauthorized structures in government-bungalows does not include a statue of late Babu Jagjiwanram ji at bungalow-number 6 at Krishna Menon Marg, New Delhi-110011 as earlier revealed by Directorate of Estate under an RTI response. Learned CPIO may kindly be directed to reveal if the statue has since been removed from there, or it was an omission in present RTI response dated 02.02.2011

Query-number (10)

Learned CPIO has demanded copying charges towards documents to be provided under query-number (10). Since the response to RTI petition is beyond 30 days’ stipulated period, I appeal CPIO may kindly be directed to provide sought documents under query-number (10) also free-of-cost under section 7(6) of RTI act like has already been done for documents relating to query number (1).



Query-number (16)

Learned CPIO has mentioned that information to query-number (16) does not pertain to his office. I appeal that my RTI petition may kindly be transferred under section 6(3) of RTI Act to the concerned public-authority having the sought information.



Query-numbers (17) to (28)

Learned CPIO has stated that these queries relate to Directorate of Estate. I appeal that my RTI petition may kindly be directed to be transferred under section 6(3) of RTI Act the Directorate of Estate. It is prayed accordingly.
