JAIPUR: The Rajasthan High Court has observed that non-consummation of marriage amounts to cruelty and said it was the principal obligation on the part of the husband to satisfy the biological urge of his wife.

Passing a decree of dissolution of marriage, the Jodhpur division Bench of the High Court said that married life without cohabitation would be a curse to the wife.

Hearing an appeal against the order of a family court, Justice Rajesh Balia and R P Vyas observed that failure to comply with one of the essential obligations of marital life by the husband would amount to subjecting the wife to cruelty.

It is principal obligation on the part of the husband to satisfy the biological urge of wife, which is a natural instinct, the court said. Marriage without sex is an anathema, the court also added. It held that sex is the foundation of marriage and harmonious sexual activity in marriage has a favourable influence on a woman’s mind and body.
